The upside-down "V" shaped branches in the upper left corner are distracting, but could probably be cloned out with a bit of work in PS. The bright leaves in the upper right corner are also distracting, but a bit of burning in could probably make them stand out less. The water is blown out down at the bottom, but that's easy to excuse if you're using a P&S where you don't have much control over the exposure - or even a way to reliably gauge it until the image is on your computer monitor. Overall, the image has potential, and it shouldn't be too hard to fix most of the little issues I see with a bit of time in Photoshop. :)

actually if you track the threads on immigrationportal.com, a ton of old-timers have gotten their GCs. A large number of these were EB3-India [2001-2004], so that 18k number does not look odd to me.
Does it look odd to you? Why?

My H1-B is expiring in December 2007. I have approved I-140 now and am hoping to get 3 year H1-B extension based on my approved I-140. Do you think I can get 3 year extension even if the visa numbers for filing AOS is current? Does AC21 apply to this case? Please suggest.

When the dates are current then only you can add your wife name to your pending 485, until then you have to wait based upon your priority dates EB1 or EB2, during this time you should maintain your H1B status inorder to keep you wife H4 status valid.

presently EB2 ---- 01 JUN 03 and EB3 ----->01 OCT 01

hi guys this is urgent plzzzzzz help
i am a pharmacist recently licensed in florida and i found 2003 approved labor but my lawyer is telling me that in order to substitute it for me i must be licensed in florida at the time of filling date of this approved labor which is in 2003.

Because you remained in the US for more than a year after USCIS denied your change of status you are barred from entering the US for 10 years. However, you are entitled to apply for a waiver of this 10 year bar pursuant to �212(d)(3)(A) of the INA which, if granted, would enable you to obtain an L-2 visa and legally enter the US.

If you are not upfront about your prior overstay, you commit visa fraud. As a consequence, you will face a lifetime bar to enter the US with little or no possibility of a waiver.

Hi All,

I have received a information regarding my EB2 (PD Jan 15 2005)Approval from my old company( Here all the fees are being met by me).I had left that company last year trying to pursue my carrier.

New company has given me an approved labour for EB3 OCt 2004 and I140 is approved.

I would like to know from experinced guys , as to what should I be doing, should I resign from new company and join back the old one?

As GC is for future employment, can i apply for I140 throgh my old company and join them back in I485 Stage?

When can we expect EB2 PD of Jan 2005 to be current.

I would appreciate your responses.

Do not expect anything, no one can tell you a specific range of dates when the priority of a Labor be current. You can join the old emp and use this priority date from the current emp of Oct 2004 to the one with PD Jan 15th 2005.
The priority date is based on a person so you can carry it anywhere only after a I-140 is approved for that labor.

So -- You at the old company can have priority date of Oct 2004.

Yes you can join the old employer when you anytime, even at the time of fillinng your I-485

Hi

I completed my 6th year H1B in April 2010 and am currently on a 7th year extension based on a pending PERM application with my current employer.

I am currently considering taking an offer from a new employer who is willing to process my H1b transfer and my question is:

1) Is it possible to transfer a 7th year extension to a new employer given that PERM will still be pending?

2) If yes, will I need to give them any evidence regarding the pending PERM as I don't have any document on it except the receipt number from DOL.

3) My current H1b expiration date is in April 2011. If the new employer files for an H1b transfer in July 2010, will I get the same H1b expiration date or a new one (i.e. July 2011)?
This is important in my case because my wife who is currently a LPR will be eligible to become a US Citizen in June 2011 and I will likely not need to go through the PERM process.


Any advice on the above will help a lot.

My wife got her F1 stamped in Mexico last week and I just noticed that her old I 94 from the time when she entered in US with her H4 is still in her passport. Is that a problem?? I remember reading some where on the forum that they are supposed to take out I 94 for the departure record...
How do I fix this?

This plea is for people who are still undecided about the rally and have lot of friends in the same situation. If there is a group of friends in the same situation it only takes one brave soul to make a decision and every one will jump in. We all seen this in trivial matters like going for vacation, movies etc..

I see the problem is in taking the first step and others will jump right in immediately. So if your friends look up for you to make the decision, please be a leader and do it now. You will not only make a difference in their life and their life as well.

Can you take that elusive first step?????. People in and around DC area it's only a day trip. Atlanta/NC/SC folks, not too late. Please PM either me or ramus.

If you have AP, I dont see an issue. Just take a copy of your I-485 and I-797...That should be enough....Also quickly print your last two paychecks.

I travelled with AP and a copy of I-485 receipt....Nothing else....

My Case:
Company A applied for GC citing future employment.
Got the EAD.
Currently I am in the pay roll of Company B(sister concern of A) in H1.
What are the things I have to do if I have to work in EAD? Can I use AC21 and move on? Do I have to work for Company A atleast for sometime?

One cannot work on H4.
i was told by my lawyer - if spouse stops working, s/he can go back to H4, but you need to confirm with a lawyer, given your specific case.
