Because you have already been counted in the H-1 quota for FY 2008, you should be able to file for a change of status to H-1 without again being subject to the quota and should not have to wait.

I filled the DS160 and took an appointment at US consulate yesterday night with out the photograph. Looks like we can submit the photograph along with the confirmation letter on the day of interview.
I thought we needed to upload the photograph for completing DS160 but that does not seem to be the case. Did any of you experience this?

Now that the economy is in the toilet, it looks like people in H-1B will have to pay for it.
An ignorant group of people don't understand that the world has now changed. They can kick out all the H-1Bs or shut-down the whole H-1B category, but it won't make the U.S. any better. The companies will just start opening offices offshore and more jobs will be lost.
I am just awfully frustrated to see the fact that whenever something goes wrong in this country, the legal immigrant community will have to pay the price.

This is a very sad message this morning I got to read from my inbox. I am not bothered about losing the pledge, but I am shocked to see only 88 members pledged. The sadest part is that this pledge is created by a US Citizen for IV.

Retrogressed members 350,000+
Why only 88 pledged? Many people wants free ride which they cannot get if they dont want to unite for the common cause. I know most of the H1b holders are paid well and spend a lot. But when it comes to donate, they feel $1 equivalent to $1000. The reason is they feel they are not getting anything in return which is not true and they feel they are smart to get a free ride when others donate.
If you dont unite for the common cause, everyone including is going to struggle to get what you want. But at least the donated members will feel good about trying their best.

Hi folks,
I have a appointment at calgary, canada for my H1 extension visa stamping. Any one has experience in Calgary.
My spouse entered the US on H4, she has a MBBS degree from india and she got H1 sponsored by a reputed university to do research.
I read on the posts that first time H4 to H1 stamping might pose a issue in canada if a person does not have degrees from US or Canada.
Please let me know.

If H1 for your spouse is already approved, there should not be any problem provided you carry all necessary documentation. If it is under processing (not yet approved), and you have your H1 approved, your spouse should not have problem for H4.

i am on h4 and this was the first time a company filed for my h1b. so would that be ok if company "B" files for my h1b with h1b filed with company "A" is pending with RFE.
Yes. I would refer to Co A's filing in the 2nd one, so that CIS doesn't think you're trying to deceive them or hide anything.

Hello everyone, i have a good news to share that i just checked my case and it shows "Card production ordered". I guess it means my 485 has been approved.

As per my lawyer, there is no worries as we filed on time, and your case is approved just today, means, they should process your wife case when time comes. May be another 4 or 6 months. As long as her case is processed without any issue, then it is fine.
I would like to hear from you guys that if anyone has got this kind of case and any inputs from you guys would be really appreciated.

Your lawyer is right. I was in the same situation. For employement based GCs you can file dependents case upto 180 days from approval. Check law 245(K)

I have my green card interview end of this month in Indianapolis. Not sure why I was called for interview at this time as I have a EB3 India case with a PD of June 2007. I am a july 2007 filer. I was wondering if someone can recommend me a good immigration lawyer around Indianapolis to accompany us for the interview.
I recently used my EAD and moved to Indianapolis. Not sure if that triggered the interview. Any genuine help would be appreciated.
