Hi,
My employer has initiated my H1 B visa for our client which is a telecom giant. I was denied H1B with the reason that I am a Mechanical Engineer. The document says that as a mechanical engineer I need 6yrs exp. I already have more than 4yrs exp in IT. The thing which wonders me is that, 2 of my engineering classmates got their H1 approved. Is there any clause which says about this. Please help me.

Get Education Evalutaion done as per job requirement.
You need someone who can write nice Theory on your Experience and Education & showing you are qualified for it. You will get H1B. All the best.

Hi,
My wife and I are currently working on EAD and have used the AP to entry the US. We will be going to the Canadian consulate to apply for Canadian Visa (want to go on vacation). I had the following questions:-
1) What all papers are required?
2) How long will they issue the canadian visa for? I am planning on obtaining a multiple entry visa. When I was on H1 they issued me a visa which was till the end of my H1 expiration date.

Not sure about the rules now, but when I did it in 2002, it was a single entry visa for 6 months - though it is single entry - going from US is an exception - from US it is multiple entry and it costed $50 during those times.
Documents - appp form, fee, your legal status here (485, EAD etc..), bank statements and usually they ask why r u visiting Canada and you can say "tourism"

Since there are lot of ppl here who have had EAD/AP for years ...
Do you know if USCIS lets you petition for renewal of EAD/AP only 4 months before expiry? Our legal assistant says that they can not apply for renewal until its 4 months to expiry. I was under the impression that we could apply six months in advance. Can someone post a USCIS link that provides a definitive answer?

The withdrawal of the H-1B is not really what decides whether you are out of status. Presumably the former employer withdrew because you no longer work there. In that case, you have been out of status since you came off payroll.
However, if there is only a short gap between your last paystub and when the new company files the H-1B, you could still be approved for a change of employer and extension. You should discuss with the lawyer preparing the new H-1B.
You should not be subject to the cap in any case, since you were already counted towards the cap within the past 6 years.

A good lawyer is worth every penny.
You, on the other hand, should play your part by being "aware" and not blindly relying on the lawyer. Your job should be to double check documents for accuracy/correctness and asking questions to the lawyer and IV to clear doubts. Making sure the lawyer is abiding by all the immigration rules as defined by the law would be another task.

Welcome to dphoto 12bar. Motorcycles, hmmmmm... lets see, my Dad used to race dirt bikes and I live in a apartment complex that shares the space with a cycle shop, that's as close as I get get there.
